What is property litigation?

Property litigation encompasses any dispute that involves land or property. When you instruct our partner-led team, we get to know what’s important to you and provide you with practical, straight-forward advice and support.

From landlord and tenant disputes for commercial, residential, agricultural land and property, to right of way/easement disputes, our highly experienced property litigators handle matters including but not restricted to:

  • Lease renewals under the Landlord and Tenant Act 1954
  • Adverse possession claims
  • Right of way/easement disputes
  • Dilapidations claims
  • Applications to assign or sub-let
  • Problems with the development of a property, such as claims to enforce restrictive covenants and planning permission disputes
  • Option agreement and overage agreement disputes
  • Professional negligence claims arising from negligent conveyancing transactions
  • Insolvency issues relating to property

When we are on your side you can rest easy in the knowledge that your case is being handled by an expert in their field, backed by the full support of other teams within the firm, to ensure your property dispute is resolved in the most effective way, as soon as possible.

How much will a property litigation lawyer cost?

As each case can vary in complexity, we advise that you contact one of our property litigators as soon as possible to discuss your case. The sooner we get to know you and your issue, the sooner we can advise you on the best course of action to take, how much it is likely to cost and whether we are prepared to offer any funding options to cover the cost of the claim. We are also able to provide an initial assessment of your case for an initial fixed fee.

Funding options

To help clients manage the costs, our Property Litigation team offers a range of funding options. From traditional ‘pay by the hour’ arrangements to fixed fees in certain situations, our aim is to take the uncertainty out of the costs of litigating and, where appropriate, to share the risk with you.

We can also offer you an initial fixed fee review and advice on the merits of your case. Click here to learn more about our fixed fee options.

Do you offer a ‘no win, no fee’ funding option?

There are certain property litigation matters where we can offer a no win, no fee agreement (also known as a Conditional Fee Agreement) in addition to a range of other funding options, which you can view by clicking here.

Some property disputes are also covered by a client’s legal expenses insurance, something that is offered as standard in many insurance policies – our team will help you identify if you are eligible to claim under your insurance policy.

How can our property litigators help you?

We act for individuals and organisations across England and Wales, providing companies, councils, investors, private individuals, estate management teams, developers and rural enterprises with high-calibre legal support.

As a client, your matter will either be handled or supervised by a partner of the firm and you will benefit from our extensive knowledge of the legal process and our ability to provide practical and pragmatic advice that can help you achieve your objectives.

Will I have to go to court?

We understand that court proceedings can be stressful, expensive and time consuming, which is why we believe it should be a last resort. Our priority is to ensure your property dispute is resolved before court proceedings are required. However, on the occasion when court proceedings are required, we will attempt to settle the matter in your favour at the earliest possible opportunity. Our dedicated team will assess your case and if necessary will use alternative dispute resolution procedures such as mediation, to resolve your dispute and maintain relationships where possible.
